These Terms and Conditions ("Terms") govern your access to and use of the website {{ shop_domain }} (the "Site") and the purchase of products from AMAI LABEL LIMITED, trading as amaï ("amaï", "we", "us", or "our"). By accessing or using the Site, placing an order, or otherwise engaging with our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Eligibility

By using the Site, you represent that you are at least 18 years old, or that you are accessing the Site under the supervision of a parent or legal guardian. If you are using the Site on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, our products, or for legal or regulatory reasons. We will post the revised Terms on the Site and update the "Last updated" date above. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

Products, Pricing and Availability

amaï designs and produces its collections in limited runs. Each piece is developed through a considered process and produced in small quantities; as a result, certain products may sell out and will not necessarily be restocked.

  • Descriptions. We attempt to describe and display our products, including colors, fabric, and sizing, as accurately as possible. However, we do not warrant that product descriptions, photography, or other content on the Site are entirely accurate, complete, reliable, or error-free. Colors may appear slightly different depending on your device display.
  • Pricing. All prices are listed in the currency displayed at checkout and are subject to change without notice. We reserve the right to correct any pricing errors on the Site, including after an order has been submitted, and will notify you before completing your order if a pricing error affects it.
  • Availability. We reserve the right to limit the quantity of any product we offer, to discontinue any product at any time, and to refuse any order.

Orders and Payment

When you place an order through the Site, you are making an offer to purchase the relevant product(s) subject to these Terms. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or issues with payment.

Payment is processed at the time of order through the payment methods available at checkout. You represent that any payment information you provide is accurate and that you are authorized to use the payment method submitted.

Shipping and Delivery

Estimated shipping and delivery dates provided on the Site, at checkout, or in order confirmations are estimates only and are not guaranteed. Because many of our pieces are produced in limited runs ahead of release, delivery timelines for pre-order or limited-release items may extend beyond standard shipping windows, and we will communicate any material delays where possible.

  • Standard shipping is free on all orders. Free express shipping is available on orders of $350 or more; on orders below that threshold, express shipping may be available for an additional fee at checkout.
  • Risk of loss and title for products purchased from us pass to you upon delivery of the products to the shipping carrier.
  • You are responsible for providing accurate shipping information. We are not responsible for delayed or failed delivery resulting from incorrect address information provided at checkout.
  • International orders may be subject to customs duties, taxes, and import fees imposed by the destination country, which are the responsibility of the customer and are not included in the item price or shipping charges.

Returns, Exchanges and Right of Withdrawal

Our Return Policy

We accept returns within 14 days of delivery for unworn, unwashed items with all original tags attached. To initiate a return, please contact our customer service team at hello@amailabel.com with your order number. Unless the item received is defective or incorrect, return shipping costs are the responsibility of the customer. Items marked as final sale, made-to-order, or otherwise indicated as non-returnable at the time of purchase are not eligible for return.

EU and UK Right of Withdrawal

If you are a consumer located in the European Union or United Kingdom, you may also have a statutory right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, in accordance with applicable consumer protection law. To exercise this right, please notify us at hello@amailabel.com before the withdrawal period expires. Returned goods must be unworn, unwashed, undamaged, and returned with all original tags attached and in otherwise resalable condition. If you withdraw from a contract in this way, we will reimburse the price paid, though we may withhold reimbursement until we have received the returned goods, and you will be responsible for the direct cost of returning the goods unless we have agreed otherwise or the goods are not as described. Where the value of the goods is diminished as a result of handling beyond what is necessary to establish their nature and characteristics, we reserve the right to deduct the corresponding amount from your refund to the extent permitted by applicable law.

Refunds

Once we receive and inspect a return, we will notify you of the approval or rejection of your refund. Approved refunds will be issued to your original method of payment within a reasonable time. We do not accept refund requests for items showing signs of wear, damage, or alteration.

Intellectual Property

The Site and all content on it, including but not limited to text, graphics, logos, images, product designs, and the amaï name and marks, are the property of amaï or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

Prohibited Uses

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
  • Attempt to gain unauthorized access to the Site, our systems, or any related network;
  • Use any automated means, including bots or scrapers, to access or collect data from the Site without our prior written consent;
  • Interfere with or disrupt the operation of the Site or the servers or networks used to make it available;
  • Engage in any conduct that restricts or inhibits any other person's use or enjoyment of the Site, or that could damage, disable, or impair the Site; or
  • Resell or exploit any portion of the Site or its content for commercial purposes without our authorization, other than through an authorized retailer or wholesale arrangement with us.

Retailers and Wholesale

Businesses interested in stocking amaï products may apply through our retailer inquiry channels on the Site. Any wholesale or retail partnership is subject to a separate agreement between amaï and the retailer, and these Terms do not govern that relationship except where expressly stated in such agreement.

Third Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by us, including payment processors and social media platforms. We are not responsible for the content, privacy practices, or terms of any third-party sites, and your use of them is at your own risk and subject to their own terms.

Disclaimers

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by applicable law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by applicable law, amaï shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or purchase of our products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the product(s) giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or the statutory rights of consumers.

Indemnification

You agree to indemnify and hold amaï, its officers, employees, and agents harmless from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles, unless mandatory consumer protection laws of your country of residence provide otherwise. Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved informally by contacting us at hello@amailabel.com. Nothing in this section limits any right you may have as a consumer to bring a claim in the courts of your country of residence under applicable law.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and amaï regarding your use of the Site and supersede any prior agreements.
